The Call
11 Questions to Ask a Bail Agent Before You Sign
By Bail Bonds Person. Checked against state sources November 2026.
A good bail agent will answer every question on this list without getting annoyed. Have them ready, because the first call usually happens when you are scared and tired.
- Have the full name, jail and booking number ready.
- Get the license number before you talk money.
- Get the total cost and every fee in writing.
- Know what you owe if the person misses court, before you sign.
Have This Ready Before You Dial
- The person's full legal name and date of birth.
- The jail and the booking number. The county sheriff's site usually has both.
- The bail amount, if you know it.
- Your own ID, job details and a way to pay.
Questions About The Person
1. What Is Your Full Name And License Number?
Then look them up on our agent lookup. The state says to always do this.1
2. Which Bail Company And Which Surety Insurer Are You With?
Agents write for surety insurers that appoint them.2 The names should match your contract.
3. Will You Be The One I Deal With?
Anyone acting on bail for the agent needs a license too.3 Ask whether the person collecting your money is licensed.
Questions About Money
4. What Is The Total, In Dollars?
The cost is most commonly 10 percent of the bond, plus actual, necessary and reasonable expenses.4 Get one number. Use our cost table to check the math.
5. What Expenses Could Be Added Later?
The rules list examples like notary fees, recording fees and out of county posting fees.5 Ask which ones apply to you.
6. Is There A Payment Plan, And What Happens If I Miss One?
Of the 166 California bail company websites we read, 118 mention payment plans. Get the plan in writing. An agent cannot send someone back to jail for not paying the premium, but the debt is still yours.1
7. Can You Lower The Fee?
You can ask. The state says an agent may choose to negotiate a lower fee by rebating, as Proposition 103 allows.4 Agents do not have to agree.
Questions About What You Are Signing
8. What Exactly Am I Liable For If The Person Misses Court?
This is the big one. Read our co-signer guide before you sign.
9. What Collateral Do You Want, And How Do I Get It Back?
Ask for a receipt that lists it. Collateral is held in trust and comes back after the bond is exonerated and the bail is paid.64
10. What Does The Person Have To Do After Release?
Ask about check ins, travel and court date reminders. Breaking the contract can make the agent surrender the person, so know the rules up front.
11. Can I Have A Copy Of Everything Before I Leave?
The answer should be yes, right away. A photo on your phone counts if there is no copier nearby. If you get a no, walk.
Answers That Should Stop You Cold
- "I'll send the license number later."
- "The total depends. We'll figure it out after."
- "Don't worry about reading that."
- "There's a yearly renewal." That is illegal.7

Fast Answers
What do I say when I call a bail bondsman?
Start with this. My family member is in jail in this county, here is the full name and booking number, and I want to know the total cost and your license number. That covers the first call.
Can a bail agent tell me which lawyer to hire?
No. California bars a licensee from recommending an attorney to the person arrested or anyone acting for them.8 If you need a lawyer, ask the State Bar or a public defender's office.
How long does it take to get out once the bond is posted?
It depends on the jail. The agent controls the paperwork, but the jail controls the release, so ask for a real range and do not plan around a promise.
This guide explains state rules in plain words. It is not legal advice, and this site is not a bail agent.
